Ruben Vardanyan Appealed to the Human Rights Defender of Azerbaijan

Vardanyan, who is in the Umpaq prison complex with 18 other citizens of Armenia, listed a number of violations in his message, which, first of all, contradict the legislation of Azerbaijan itself.

Վարդանեան, որ Հայաստանի 18 այլ քաղաքացիներու հետ կը գտնուի Ումպաքի քրէակատարողական համալիրին մէջ, իր ուղերձին մէջ թուարկած է շարք մը խախտումներ, որոնք նախ եւ առաջ կը հակասեն նոյնինքն Ատրպէյճանի օրէնսդրութեան։

He referred to the Code of Execution of Sentences and the booklet on the rights of convicts, which the Office of the Human Rights Defender of Azerbaijan provided to prisoners in April of this year. He stressed that these rights must be protected regardless of the article of the charge, nationality, religious affiliation, and citizenship.

Ան յղում կատարած է Պատիժներու կատարման օրէնսգիրքին եւ դատապարտեալներու իրաւունքներուն վերաբերող գրքոյկին, զոր այս տարուան Ապրիլին Ատրպէյճանի Մարդու իրաւունքներու պաշտպանի գրասենեակը տրամադրած է բանտարկեալներուն։ Ան շեշտած է, որ այդ իրաւունքները պէտք է պահպանուին՝ անկախ մեղադրանքի յօդուածէն, ազգութենէն, կրօնական պատկանելիութենէն եւ քաղաքացիութենէն։

Among the problems raised by Vardanyan are the lack of weekly telephone communication and the unavailability of video calls for a part of the prisoners, due to which some of them have not seen their children for almost three years. He also mentioned the inability to conduct medical examinations at their own expense, the difficulty of drawing up a power of attorney in the name of relatives due to the refusal of notary services, the limitation of physical exercises to once a week, for 20-40 minutes, instead of the prescribed one hour per day, as well as the lack of written responses to applications and complaints.

Վարդանեանի բարձրացուցած խնդիրներուն շարքին են՝ բանտարկեալներուն մէկ մասին համար շաբաթական դրութեամբ հեռաձայնային հաղորդակցութեան բացակայութիւնը եւ տեսազանգերու անհասանելիութիւնը, որուն պատճառով անոնցմէ ոմանք գրեթէ երեք տարիէ ի վեր չեն տեսած իրենց զաւակները։ Ան յիշատակած է նաեւ սեփական միջոցներով բժշկական քննութիւններ կատարելու անկարելիութիւնը, նոտարական ծառայութիւններու մերժման պատճառով հարազատներուն անունով լիազօրագիր ձեւակերպելու դժուարութիւնը, ֆիզիքական վարժութիւններու սահմանափակումը՝ շաբաթական մէկ անգամ, 20-40 վայրկեան տեւողութեամբ՝ օրական սահմանուած մէկ ժամուան փոխարէն, ինչպէս նաեւ դիմումներուն եւ բողոքներուն գրաւոր պատասխաններու բացակայութիւնը։

Vardanyan specifically addressed the fact that after the cessation of the activities of the International Committee of the Red Cross in Azerbaijan, prisoners were deprived of an important means of communication with their families, and most of them did not receive parcels. He also emphasized that many do not even have the opportunity to buy food from the prison store or make phone calls, because they lack funds.

Վարդանեան յատուկ կերպով անդրադարձած է այն հանգամանքին, որ Ատրպէյճանի մէջ Կարմիր խաչի միջազգային կոմիտէի գործունէութեան դադրեցումէն ետք բանտարկեալները զրկուած են ընտանիքներուն հետ կապի կարեւոր միջոցէ, իսկ անոնց մեծ մասը չի ստանար ծանրոցներ։ Ան նաեւ ընդգծած է, որ շատեր նոյնիսկ հնարաւորութիւն չունին բանտային խանութէն սննդամթերք գնելու կամ հեռաձայններ կատարելու, որովհետեւ միջոցներու կը պակսին։

He also recalled the initiative of his wife, Veronika Zonapend, who is ready to travel to Baku, meet with the Human Rights Defender and convicted citizens of Armenia, and deliver about a thousand letters, parcels and necessary items to them. However, his applications remained unanswered, and no alternative solution was proposed.

Ան յիշեցուցած է նաեւ իր կնոջ՝ Վերոնիքա Զոնապենտի նախաձեռնութիւնը, որ պատրաստակամ է մեկնելու Պաքու, հանդիպում ունենալու Մարդու իրաւունքներու պաշտպանին եւ Հայաստանի դատապարտուած քաղաքացիներուն հետ, անոնց փոխանցելու մօտ հազար նամակ, ծանրոցներ եւ անհրաժեշտ իրեր։ Սակայն անոր դիմումները մնացած են անպատասխան, եւ այլընտրանքային լուծում չէ առաջարկուած։

Vardanyan suggested that the Human Rights Defender meet with the prisoners, adding: "It doesn't matter how much longer we spend in Umpaki. Please follow your own laws," he stressed.

Վարդանեան առաջարկած է Մարդու իրաւունքներու պաշտպանին հանդիպում ունենալ բանտարկեալներուն հետ՝ աւելցնելով. «Կարեւոր չէ, թէ տակաւին որքան ժամանակ կ՛անցընենք Ումպաքիի մէջ։ Կը խնդրեմ՝ հետեւեցէ՛ք ձեր իսկ օրէնքներուն», շեշտած է ան։
