La "complicidad" del Tribunal Constitucional con el gobierno de Pashinyan
The Constitutional Court of Armenia refused to consider an appeal from the parliamentary blocs of the Strong Armenia Party and the Armenian Alliance, which challenged the constitutionality of the government program provisions relating to the Armenian Apostolic Church.
El Tribunal Constitucional de Armenia rechazó considerar una apelación de los bloques parlamentarios del Partido Armenia Fuerte y de la Alianza Armenia, que impugnaban la constitucionalidad de las disposiciones del programa del gobierno relativas a la Iglesia Apostólica Armenia.

Opposition blocs challenged Resolution No. AZHO-3-N of the National Assembly, dated August 25, 2026, which approves the government's program. According to the plaintiffs, "the document provides for state interference in the internal affairs of the Armenian Apostolic Church (AAC), which is contrary to the Constitution of Armenia, Article 9 of the European Convention on Human Rights, the jurisprudence of the ECHR, and the principle of separation of church and state enshrined in the Venice Commission."
Las bancadas de la oposición impugnaron la Resolución Nº AZHO-3-N de la Asamblea Nacional, con fecha 25 de agosto de 2026, que aprueba el programa del gobierno. Según los demandantes, "el documento prevé la injerencia del Estado en los asuntos internos de la Iglesia Apostólica Armenia (IAA), lo cual es contrario a la Constitución de Armenia, al artículo 9 del Convenio Europeo de Derechos Humanos, a la jurisprudencia del CEDH y al principio de separación entre la Iglesia y el Estado consagrado en la Comisión de Venecia".
The opposition argued that "the challenged provisions transform matters of the Church's internal canonical governance into objectives of state policy, violating the rights of the AAC, as well as the right of citizens to freedom of conscience and religion."
La oposición argumentó que "las disposiciones impugnadas transforman cuestiones de la gobernanza canónica interna de la Iglesia en objetivos de la política estatal, violando los derechos de la IAA, así como el derecho de los ciudadanos a la libertad de conciencia y de religión".
However, the Constitutional Court, in its procedural decision, dismissed the appeal and refused to consider the request submitted by the opposition blocs. The Constitutional Court stated that matters concerning the political success and validity of the government's program fall under the purview of Parliament, not the Constitutional Court. Furthermore, the Court emphasized that, within the framework of abstract constitutional review, it is impossible to assess proposed future unconstitutional laws as contradictions with existing constitutional provisions.
Sin embargo, el Tribunal Constitucional, mediante su decisión procesal, desestimó el recurso y rechazó considerar la solicitud presentada por los bloques opositores. El Tribunal Constitucional señaló que las cuestiones relativas al éxito político y la validez del programa del gobierno son competencia del Parlamento, no de la justicia constitucional. Asimismo, el Tribunal subrayó que, en el marco del control de constitucionalidad abstracto, es imposible evaluar las normas futuras inconstitucionales propuestas como contradicciones constitucionales ya existentes.
Lawyer Arminé Fanian said, "Pashinyan's statements are sufficient to understand that this is an orchestrated process, and that the State is interfering in the internal affairs of the Church. It is not a legal process, but a political agenda directed against our State and the Church."
La abogada Arminé Fanian dijo que "las declaraciones de Pashinyan son suficientes para entender que se trata de un proceso orquestado, y que el Estado está interviniendo a nivel estatal en la vida interna de la iglesia. No es un proceso legal, sino una agenda política dirigida contra nuestro Estado y la iglesia".
According to the lawyer, Armenian law clearly prohibits interference in the internal affairs of religious organizations. "Of course, whenever the State carries out an illegal process, the Church will follow suit with a legal process. In general, we will not change our approach, but will attempt to resolve this issue solely through the procedures established by law," Fanian said.
Según la letrada, la legislación de Armenia establece claramente la prohibición de interferir en la vida interna de las organizaciones religiosas. "Por supuesto, cada vez que el Estado lleve a cabo un proceso ilegal, seguirá un proceso legal por parte de la iglesia. En general, no cambiaremos nuestra forma de actuar, sino que intentaremos resolver este problema únicamente a través de los procedimientos establecidos por la ley", dijo Fanian.
"Nikol Pashinyan's statements about his involvement in introducing modifications to a 'report' against the church are essentially a confession of a crime," said social activist Hovhannes Ishkhanyan, referring to the prime minister's remarks during a recent television interview.
"Las declaraciones de Nikol Pashinyan sobre su participación en la introducción de modificaciones en un 'informe' contra la iglesia, es esencialmente la confesión de un delito", dijo el activista social Hovhannés Ishkhanyan, haciendo referencia a los dichos del primer ministro durante una reciente entrevista televisiva.
