VIDEO: How the judge in the case of the Catholicos' brother and his son was "pressured"

Pressure is being exerted on judges before making decisions on high-profile criminal cases.

Yesterday, the brother of Catholicos of All Armenians Garegin II, Gevorg Nersisyan, and his son, Hambardzum Nersisyan, were found guilty.

Երեկ Ամենայն հայոց կաթողիկոս Գարեգին Բ–ի եղբայրը` Գևորգ Ներսիսյանը, ու նրա որդին՝ Համբարձում Ներսիսյանը, մեղավոր ճանաչվեցին։

The Armavir Regional Court, presided over by Gevorg Manukyan, had issued a guilty verdict.

Արմավիրի մարզի դատարանը՝ նախագահությամբ Գևորգ Մանուկյանի, մեղադրական վերդիկտ էր կայացրել։

“The court finds that the criminal illegality of the mentioned act has been proven, the commission of the mentioned act by Gevorg Nersisyan and Hambardzum Nersisyan has been proven.

«Դատարանը գտնում է, որ ապացուցված է նշված արարքի քրեական հակաիրավականությունը, ապացուցված է Գևորգ Ներսիսյանի և Համբարձում Ներսիսյանի կողմից նշված արարքը կատարելը։

Their guilt in committing the mentioned act has been proven.

Ապացուցված է նրանց մեղավորությունը նշված արարքը կատարելու մեջ։

Guided by Articles 342 to 344 of the Criminal Procedure Code of the Republic of Armenia, the court decided to issue a guilty verdict in criminal proceedings.

Ղեկավարվելով ՀՀ քրեական դատավարության օրենսգրքի 342–ից 344–րդ հոդվածներով, դատարանը որոշեց քրեական վարույթով կայացնել մեղադրական վերդիկտ։

To find Hambardzum Nersisyan guilty of committing an act provided for in Article 211, Part 2, Clause 5 of the Criminal Code of the Republic of Armenia.

Համբարձում Ներսիսյանին մեղավոր ճանաչել ՀՀ քրեական օրենսգրքի 211–րդ հոդվածի 2–րդ մասի 5–րդ կետով նախատեսված արարք կատարելու մեջ։

"To find Gevorg Nersisyan guilty of committing the act provided for in Article 211, Part 2, Clause 5 of the Criminal Code of the Republic of Armenia," the judge said.

Գևորգ Ներսիսյանին մեղավոր ճանաչել ՀՀ քրեական օրենսգրքի 211–րդ հոդվածի 2–րդ մասի 5–րդ կետով նախատեսված արարքի կատարման մեջ»,–ասել էր դատավորը։

Let us recall that public criminal prosecution has been initiated against them under Article 211 of the Criminal Code of the Republic of Armenia (obstructing the exercise of electoral rights, the activities of the electoral headquarters, or the exercise of the free will of persons participating in the election).

Հիշեցնենք, որ նրանց նկատմամբ հանրային քրեական հետապնդում է հարուցվել ՀՀ քրեական օրենսգրքի 211-րդ հոդվածով (ընտրական իրավունքի իրականացմանը, ընտրական շտաբի աշխատանքներին կամ ընտրությանը մասնակցող անձանց ազատ կամքի իրականացմանը խոչընդոտելը)։

However, let us record that prior to this decision, disciplinary proceedings had been initiated against the judge of the General Jurisdiction Court of Armavir Region, Judge Gevorg Manukyan, who examined the case regarding the brother and nephew of His Holiness the Patriarch, Hambardzum and Gevorg Nersisyan, by the Minister of Justice of the Republic of Armenia.

Սակայն արձանագրենք Վեհափառ Հայրապետի եղբոր և եղբորորդու՝ Համբարձում և Գևորգ Ներսիսյանների վերաբերյալ գործը քննող դատավորի՝ Արմավիրի մարզի ընդհանուր իրավասության դատարանի դատավոր Գևորգ Մանուկյանի նկատմամբ մինչ այս որոշումը կարգապահական վարույթ էր հարուցվել՝ ՀՀ արդարադատության նախարարի կողմից։

On September 10, the Ministry of Justice already submitted a petition to the Supreme Court of Justice to subject Manukyan to disciplinary liability, but what alleged violation is attributed to Manukyan and for what reason is not yet officially known.

ԱՆ-ն սեպտեմբերի 10-ին արդեն ԲԴԽ է ներկայացրել միջնորդությունը՝ Մանուկյանին կարգապահական պատասխանատվության ենթարկելու վերաբերյալ, թե ինչ ենթադրյալ խախտում է վերագրվում Մանուկյանին և ինչ գործով՝ դեռևս պաշտոնապես հայտնի չէ։

The hearing date at the Civil Court of Appeals has been set for October 12 at 2:00 PM.

It is not excluded that through disciplinary proceedings, Manukyan was made to understand what he should do so that his actions would not have fatal consequences later.

It should be noted that on the same day, the Civil Court of Appeals will also consider the petition regarding Judge Nora Karapetyan.

Disciplinary proceedings have also been initiated against her by the Minister of Justice of the Republic of Armenia.

Նշենք, որ նույն օրը ԲԴԽ-ում կքննվի նաև Վերաքննիչ քաղաքացիական դատարանի դատավոր Նորա Կարապետյանի վերաբերյալ միջնորդությունը։
