The Department for the Protection of State Interests of the Central Military Prosecutor's Office has examined the legality of the alienation process of the Van Lake Paradise restaurant complex and the adjacent 2.56 ha of land located in the Kasakh Gorge recreation area of the Ashtarak community of Aragatsotn region. The Prosecutor General's Office reported this.

Զինվորական կենտրոնական դատախազության պետական շահերի պաշտպանության բաժնի կողմից ուսումնասիրվել է Արագածոտնի մարզի Աշտարակ համայնքի Քասախի կիրճ հանգստի գոտում գտնվող Վանա լիճ դրախտ ռեստորանային համալիրի և դրան կից 2,56 հա հողամասի օտարման գործընթացի իրավաչափությունը։ Այս մասին հաղորդում է Գլխավոր դատախազությունը:

The study revealed that, according to the report of the Minister of Defense, without the property valuation carried out in the prescribed manner, the RA Government's Resolution No. 337-A of March 18, 2004, allowed the alienation of state-owned buildings and structures of the recreation area by direct sale to an individual, setting the sale price at 500 thousand US dollars. Meanwhile, the same property was estimated at 500 thousand US dollars back in 1997, after which the complex was expanded, built and improved. Moreover, about a year after the alienation, under the real estate mortgage agreement of April 26, 2005, the liquidation value of the same property was set at 700 thousand US dollars.

Ուսումնասիրությամբ պարզվել է, որ Պաշտպանության նախարարի զեկուցմամբ, առանց սահմանված կարգով իրականացված գույքի գնահատման՝ ՀՀ կառավարության 2004 թվականի մարտի 18-ի թիվ 337-Ա որոշմամբ, թույլատրվել է պետական սեփականություն հանդիսացող հանգստի գոտու շենքերն ու շինություններն ուղղակի վաճառքի եղանակով օտարել ֆիզիկական անձին՝ վաճառքի գինը սահմանելով 500 հազար ԱՄՆ դոլար։ Մինչդեռ, նույն գույքը դեռևս 1997 թվականին գնահատվել է 500 հազար ԱՄՆ դոլար, որից հետո համալիրն ընդլայնվել, կառուցապատվել և բարեկարգվել է։ Դեռ ավելին, օտարումից շուրջ մեկ տարի անց՝ 2005 թվականի ապրիլի 26-ի անշարժ գույքի հիփոթեքի պայմանագրով, նույն գույքի լիկվիդացիոն արժեքը սահմանվել է 700 հազար ԱՄՆ դոլար։

The study also revealed that without a legal and contractual basis, a lease right to a 2.56 ha plot of land was registered in the name of an individual, which later served as the basis for the latter's acquisition of gratuitous ownership rights to a plot of land with a cadastral value of 115 million 814 thousand 400 drams.

Ուսումնասիրությամբ պարզվել է նաև, որ առանց իրավական և պայմանագրային հիմքի ֆիզիկական անձի անվամբ գրանցվել է 2,56 հա հողամասի նկատմամբ վարձակալության իրավունքը, որը հետագայում հիմք է հանդիսացել 115 միլիոն 814 հազար 400 դրամ կադաստրային արժեքով հողամասի նկատմամբ վերջինիս կողմից անհատույց սեփականության իրավունքի ձեռքբերման համար:

The prosecutor, having discovered apparent elements of a crime within the framework of exercising his powers to protect state interests, filed a report on the crime with the Anti-Corruption Committee, and criminal proceedings were initiated.
