Former Foreign Minister of the Republic of Artsakh (Nagorno-Karabakh), Davit Babayan, reported on October 1st from an Azerbaijani prison that the lawyers for three Armenian prisoners filed appeals with the Azerbaijani Supreme Court after receiving the electronic version of the appeals court's ruling that upheld the initial sentences.
Babayan, who is serving a life sentence in Baku, sent a message to News.am in which he stated that "two important things" related to the legal proceedings had occurred in recent days.
“On the 18th of the month, we received the electronic version of the appeals court's ruling. Naturally, it has no signature or official notation. However, it was delivered to us, totaling 47 volumes. Secondly, our lawyers have filed an appeal with the Supreme Court. The lawyers for three individuals have done so; the lawyers for the others have not, or at least we have no record of them doing so,” he explained.
Babayan did not specify who the three prisoners are whose lawyers filed the appeals. The former Artsakh official also noted that his own lawyers filed an appeal, although they were unable to meet with him.
“A well-founded complaint was filed. I want to thank my defense attorney, because it details all the violations of the law and international law,” he stated.
According to Babayan, the review stage will now begin before the Supreme Court of Azerbaijan, although he said he did not know when the case would be heard.
“In other words, these legal, political, and moral violations, these flagrant abuses, will continue to occur in the same way. But that's not important to us; what's important is that we overcome this formal process in the future, both for history and for our next steps,” he maintained.
Babayan also questioned the appeals court's ruling, stating that “it is 99.9 percent a copy of the prosecution's and the trial court's decision, and it doesn't differ in any way.”
The former minister also addressed the content of some of the accusations made against him. “They accuse me of enormous economic abuses, even though they’ve never been involved in the business dealings. I tell them they’ve presented me as if I owned British Petroleum. Or, for example, they accuse me of having been part of some committee, from September 1988 until September 28, 1991, that made decisions about war and peace. Well, I say this ironically: September 1988 is clear, I was transferred to the tenth grade, perhaps that’s the criterion, but why December 28, 1991, and not the 27th or the 29th? It’s incomprehensible. In other words, this is a document that has suffered low-level censorship,” he stated.
Babayan also denounced that one of the volumes of the file was not delivered. “I must also say that the final volume, number 47, of the Appeals Court documents, comprising 333 pages, was not accepted at all. The justification for the decision, the reason why all those rulings remained unchanged, is written there and was not presented,” he stated.
Davit Babayan remains imprisoned in Azerbaijan along with other former political and military leaders from Artsakh, detained following the Azerbaijani offensive of September 2023 and the forced displacement of the Armenian population from the region.
