Call for international experts to examine the indictment and sentence against Ruben Vardanyan

The publication was announced by lawyer Siranush Sahakyan, director of the NGO Center for International and Comparative Law and representative of Armenian prisoners of war and detainees before the European Court of Human Rights, during a press conference. Sahakyan called on lawyers, researchers, professors, legal departments, professional associations, and students to analyze the documentation and conduct an independent evaluation of the process.

La publicación fue anunciada por la abogada Siranush Sahakyan, directora de la ONG Centro de Derecho Internacional y Comparado y representante de los prisioneros de guerra y detenidos armenios ante el Tribunal Europeo de Derechos Humanos, durante una rueda de prensa. Sahakyan llamó a abogados, investigadores, profesores, departamentos jurídicos, asociaciones profesionales y estudiantes a analizar la documentación y realizar una evaluación independiente del proceso.

“Our study of this verdict showed us that numerous unprecedented human rights violations occurred, that the entire trial was a sham, that its outcome is illegitimate, and, of course, we have presented our legal arguments to the European Court of Human Rights,” Sahakyan stated.

"El estudio de este veredicto nos demostró que se produjeron numerosas violaciones de derechos humanos sin precedentes, que todo el juicio fue una farsa, que su resultado no es legítimo y, por supuesto, hemos presentado nuestros argumentos legales ante el Tribunal Europeo de Derechos Humanos", afirmó Sahakyan.

The lawyer reported that Vardanyan’s case has already been assigned a case number and will be examined by the European Court of Human Rights.

La abogada informó que el caso de Vardanyan ya recibió un número de expediente y será examinado por el Tribunal Europeo de Derechos Humanos.

“Ruben Vardanyan’s case has already been assigned a number and will be examined by the European Court; we will also provide details at the appropriate stages,” she noted.

"El caso de Ruben Vardanyan ya tiene número asignado y será examinado por el Tribunal Europeo; también facilitaremos detalles en las fases correspondientes", señaló.

Sahakyan maintained that the ruling also sets a precedent due to the nature of the arguments and evidence used.

“This verdict also sets a precedent, where not only legal and moral norms are violated, but also the limits of common sense and human intelligence. The facts and the alleged ‘evidence’ presented there, as well as the conclusions drawn from them, simply do not conform to the realm of sound human judgment, common sense, or reason,” she stated.

"Este veredicto también sienta un precedente, donde no solo se violan las normas legales y morales, sino también los límites del sentido común y la inteligencia humana. Los hechos y las supuestas 'pruebas' allí presentadas, así como las conclusiones extraídas a partir de ellas, simplemente no se ajustan al ámbito del juicio humano sensato, el sentido común ni la razón", afirmó.

The representative of the Armenian prisoners before the European Court emphasized the importance of having the case file analyzed by specialists.

La representante de los prisioneros armenios ante el Tribunal Europeo remarcó la importancia de que el expediente sea analizado por especialistas.

“For us, it is very important that professional communities, academics, and students study and be able to form an independent and unbiased opinion on this trial and the resulting verdict,” Sahakyan said.

"Para nosotros es muy importante que las comunidades profesionales, los académicos y los estudiantes estudien y puedan formarse una opinión independiente y sin ayuda sobre ese juicio y el veredicto resultante", dijo Sahakyan.

According to the published documentation, the formal indictment consists of 1,945 pages and the judgment of 1,357 pages. The Azerbaijani court held Vardanyan criminally responsible for his connection to what Azerbaijani authorities call a "criminal organization," referring to the institutional structures of the Republic of Artsakh.

The ruling attributes to this alleged organization activities carried out over 36 years, including events between 1988 and 1994, when Vardanyan was approximately 20 years old and a student. The Baku Military Court placed the date of his alleged involvement with the organization in December 2020, although he was residing in Moscow at the time.

La sentencia atribuye a esa supuesta organización actividades desarrolladas durante 36 años, incluidos acontecimientos ocurridos entre 1988 y 1994, cuando Vardanyan tenía aproximadamente 20 años y era estudiante. El Tribunal Militar de Bakú situó en diciembre de 2020 el momento en que supuestamente se incorporó a esa organización, aunque entonces residía en Moscú.

Sahakyan noted that Vardanyan was charged with dozens of acts and offenses, including assault and responsibility for destruction and human casualties.

Vardanyan assumed the position of Minister of State of Artsakh on November 4, 2022. According to Sahakyan, he had no involvement or presence in the events for which he was held responsible, had no command authority over the Armenian armed forces or the Artsakh army, and was not part of decision-making processes.

The lawyer also questioned one of the pieces of evidence used in connection with an incident in which injuries were attributed to a victim. "However, an incident was confirmed, the supposed 'proof' of which was the testimony of a victim who had never seen Vardanyan. This victim only stated that he suffered injuries as a result of an attack," she explained.

La abogada también cuestionó una de las pruebas utilizadas en relación con un incidente en el que se atribuyeron heridas a una víctima. "Sin embargo, se confirmó un incidente, cuya supuesta 'prueba' fue el testimonio de una víctima que nunca había visto a Vardanyan. Esta víctima solo declaró haber sufrido heridas como consecuencia de un ataque", explicó.

Sahakyan also pointed out that various charitable activities carried out by Vardanyan were considered criminal activities by the Baku court.

Sahakyan también señaló que distintas actividades benéficas desarrolladas por Vardanyan fueron consideradas actividades delictivas por el tribunal de Bakú.

"Ruben Vardanyan has implemented various charitable programs and actively participated in social programs, but these actions have also been classified as criminal activities. For example, he renovated schools and kindergartens, and financed a large wedding in Artsakh, serving as the best man, which has also been classified as criminal activity," she emphasized.

"Ruben Vardanyan ha implementado diversos programas benéficos y ha participado activamente en programas sociales, pero estos actos también han sido calificados como actividades delictivas. Por ejemplo, renovó escuelas y jardines de infancia, o financió una gran boda en Artsaj, siendo él mismo el padrino de dicha boda, lo cual también ha sido calificado como actividad delictiva", enfatizó.

Among the elements questioned by Sahakyan is also the Aurora Humanitarian Initiative, a global non-profit organization. According to the lawyer, the Azerbaijani court classified its activities as criminal and considered its award recipients to be members of a criminal organization.

Entre los elementos cuestionados por Sahakyan se encuentra también la Iniciativa Humanitaria Aurora, organización sin ánimo de lucro de alcance mundial. Según la abogada, el tribunal azerbaiyano calificó sus actividades como delictivas y consideró a sus galardonados como miembros de una organización criminal.

"Furthermore, the Republic of Nagorno-Karabakh (RNK), with all its subdivisions, has been perceived [by Azerbaijan] as an armed, militarized, and illegal group, and any relationship with the RNK has been classified as participation in a criminal organization," she maintained.

"Además, la República de Nagorno Karabaj (RNK), con todas sus subdivisiones, ha sido percibida [por Azerbaiyán] como un grupo armado, militarizado e ilegal, y cualquier relación con la RNK ha sido calificada como participación en una organización criminal", sostuvo.

The representative of the Armenian prisoners also questioned the methodology used by the Azerbaijani side to count the victims of the conflict.

La representante de los prisioneros armenios también cuestionó la metodología utilizada por la parte azerbaiyana para contabilizar las víctimas del conflicto.

"The Azerbaijani side has also conducted a count of victims using a methodology unknown to us. According to them, more than 18,000 residents have died in the context of the Artsakh conflict. They claim that, since Ruben Vardanyan joined this 'criminal organization' in 2022 and held a position, he is solely responsible for all human lives lost. In other words, Ruben Vardanyan must personally assume responsibility for the victims and those who disappeared during the conflict," she stated.

"La parte azerbaiyana también ha realizado un recuento de víctimas utilizando una metodología que desconocemos. Según ellos, más de 18.000 residentes han muerto en el marco del conflicto de Artsaj. Afirman que, dado que Ruben Vardanyan se unió a esa 'organización criminal' en 2022 ocupando un cargo, es el único responsable de todas las vidas humanas. Es decir, Ruben Vardanyan debe asumir personalmente la responsabilidad de las víctimas y de las personas desaparecidas durante el conflicto", afirmó.

Finally, Sahakyan questioned the tribunal's interpretation of Vardanyan's assumption of the position of Minister of State.

“The takeover itself was also considered a usurpation of power, a violation of the Azerbaijani constitution, and the takeover was presented as the usurpation of Azerbaijan’s sovereign power by Ruben Vardanyan, who held power in Azerbaijan from November 2022 to February 2023,” he said.

"La toma de posesión en sí misma también fue considerada una usurpación de poder, una violación de la constitución de Azerbaiyán, y la toma de posesión fue presentada como la usurpación del poder soberano de Azerbaiyán por parte de Ruben Vardanyan, quien ejerció el poder en Azerbaiyán desde noviembre de 2022 hasta febrero de 2023", dijo.
