Some employers will be exempt from fines imposed by the Pension Fund.

The Georgian Parliament reviewed amendments to the Law on Funded Pensions in its third and accelerated reading and, with 76 votes in favor, approved amendments to the Law on Funded Pensions, which exempt employers from fines imposed by the Pension Fund.

The issue was introduced at the meeting by Paata Kvizinadze, Chairman of the Parliamentary Committee on Financial and Budgetary Affairs.

The legislative package provides for a conditional exemption of employers from administrative penalties—fines—imposed by the Pension Fund after May 1, 2025, provided that the relevant employers fully make pension contributions and pay accrued penalties no later than December 31, 2026.

Законодательный пакет предусматривает условное освобождение работодателей от административных взысканий — штрафов, наложенных Пенсионным фондом после 1 мая 2025 года, при условии, что соответствующие работодатели полностью осуществят пенсионные взносы и выплатят начисленные пени не позднее 31 декабря 2026 года.

Furthermore, the fine is being reduced: instead of 500 and 1,000 lari for the first and second violations, respectively, the fine will be 300 lari.

The bill provides for new regulations regarding violations of the obligation to make pension contributions.

Законопроект предусматривает новое регулирование отношений, связанных с нарушением обязанности по осуществлению пенсионных взносов.

Specifically, the bill introduces the concept of "lost benefit," establishes procedures for identifying violations of pension contribution obligations, imposing fines on employers, and calculating lost benefit accruals for participants, as well as procedures for enforcement and appeal. Furthermore, the bill provides for the possibility of installment payments (phased payments) for unpaid pension contributions and lost benefit.

В частности, законопроект вводит понятие «неполученной выгоды», устанавливает порядок выявления нарушения обязанности по осуществлению пенсионного взноса, наложения штрафа на работодателя и начисления участнику неполученной выгоды, а также порядок их исполнения и обжалования. Кроме того, предусматривается возможность рассрочки (поэтапной выплаты) неосуществлённых пенсионных взносов и неполученной выгоды.

At the same time, a Pension Fund dispute resolution service is being established, and the procedure for its consideration of complaints and decision-making is being defined.
