According to the decision of the Abovyan community council of the Kotayk region of the Republic of Armenia No. 29-A dated February 12, 2026, the following real estate is subject to alienation

* Name and location of the auction organizer: Head of the Abovyan community of the Kotayk region of the Republic of Armenia, Kotayk region, Abovyan community, Abovyan city, Barekamutyan Square 1, RA.

* Աճուրդի կազմակերպչի անվանումը, գտնվելու վայրը՝ ՀՀ, Կոտայքի մարզի Աբովյան համայնքի ղեկավար, ՀՀ, Կոտայքի մարզ, Աբովյան համայնք, Աբովյան քաղաք, Բարեկամության հրապարակ 1։

* The auction can be attended by individuals and legal entities, as well as the state (except for cases provided for by law),

* Աճուրդի մասնակից կարող են հանդիսանալ ֆիզիկական և իրավաբանական անձինք, ինչպես նաև պետությունը (բացառությամբ օրենքով նախատեսված դեպքերի),

* After registering and logging in to the Electronic System (https://www.e-auctions.am/) for participation in the auction, it is necessary to pay an advance payment through the e-payments system at least 5 minutes before the end of the period specified in paragraph 18 of the appendix established by the Resolution of the Government of the Republic of Armenia N 1667-N of September 28, 2023.

* Աճուրդի մասնակցության համար Էլեկտրոնային համակարգում (https://www.e-auctions.am/) գրանցվելուց և մուտք գործելուց հետո անհրաժեշտ է e-payments համակարգի միջոցով Հայաստանի Հանրապետության կառավարության 2023 թվականի սեպտեմբերի 28-ի N 1667-Ն որոշմամբ սահմանված հավելվածի 18-րդ կետով սահմանված ժամկետի ավարտից առնվազն 5 րոպե առաջ վճարել նախավճար:

* The estimated time of the end of the electronic auction is set by paragraphs 20 and 21 of the appendix established by the Resolution of the Government of the Republic of Armenia N 1667-N of September 28, 2023.

* Աճուրդի վերաբերյալ անհրաժեշտ և լրացուցիչ տեղեկատվություն ու տեխնիկական աջակցություն ստանալու համար մասնակիցները կարող են զանգահարել 044536412 հեռախոսահամարին կամ այցելել ՀՀ, Կոտայքի մարզ, Աբովյան համայնք, Բարեկամության հրապարակ 1։

Submission of bids for participation in the auction and conditions:

Աճուրդի մասնակցության հայտերի ներկայացնելը և պայմանները՝

-The auction may be attended by persons who may have ownership rights to the lot being sold,

-Աճուրդին կարող են մասնակցել այն անձինք, ովքեր վաճառվող լոտի նկատմամբ կարող են ունենալ սեփականության իրավունք,

-Registration of participants in the electronic system is carried out online, registration is carried out in accordance with the procedure established by paragraph 16 of the Appendix established by the Resolution of the Government of the Republic of Armenia N 1667-N of September 28, 2023.

-Էլեկտրոնային համակարգում մասնակիցների գրանցումն իրականացվում է առցանց եղանակով, գրանցումն իրականցվում է Հայաստանի Հանրապետության կառավարության 2023 թվականի սեպտեմբերի 28-ի N 1667-Ն որոշմամբ սահմանված հավելվածի 16-րդ կետով սահմանված կարգով:

The procedure for conducting the auction and determining the winner of the auction:

Աճուրդի անցկացման և աճուրդում հաղթողին որոշելու կարգը՝

- In the event of each new price offer during the last minute preceding the end of the electronic auction, the auction continues for another 1 minute, counting from the moment of receipt of the offer. During the auction, each participant has the right to submit a new price offer, which must exceed the previous price offer made by the participants by at least the minimum amount of the increase. Moreover, more than one lot may start simultaneously, but each subsequent lot may end at least 1 minute after the end of the previous lot.

– Էլեկտրոնային աճուրդի ավարտին նախորդող վերջին րոպեի ընթացքում յուրաքանչյուր նոր գնային առաջարկի դեպքում աճուրդը շարունակվում է ևս 1 րոպե՝ հաշված առաջարկի ստացման պահից: Աճուրդի ընթացքում յուրաքանչյուր մասնակից իրավունք ունի ներկայացնելու նոր գնային առաջարկ, որը պետք է գերազանցի մասնակիցների կատարած նախորդ գնային առաջարկը՝ առնվազն նվազագույն հավելման չափով: Ընդ որում, մեկից ավելի լոտերը կարող են սկսվել միաժամանակ, սակայն յուրաքանչյուր հաջորդ լոտ կարող է ավարտվել նախորդ լոտի ավարտից առնվազն 1 րոպե հետո։

– The winner of the electronic auction is the participant who submitted the highest price bid. The winner is determined by the system. On the day of the electronic auction, the organizer draws up a protocol regarding the winning participant in accordance with the form specified in this procedure and sends it online to the winning participant for signing and submitting the necessary documents.

– Էլեկտրոնային աճուրդի հաղթող է ճանաչվում ամենաբարձր գնային հայտ ներկայացրած մասնակիցը: Հաղթողը որոշվում է համակարգի միջոցով: Կազմակերպիչն էլեկտրոնային աճուրդի կայացման օրը հաղթող մասնակցի վերաբերյալ կազմում է սույն կարգով սահմանված ձևին համապատասխան արձանագրություն և առցանց եղանակով ուղարկում է հաղթող մասնակցին այն ստորագրելու և անհրաժեշտ փաստաթղթերը ներկայացնելու համար։

– The winning participant of the electronic auction shall transfer the signed protocol and the documents specified in paragraph 22 of the appendix specified by the Resolution of the Government of the Republic of Armenia No. 1667-N of September 28, 2023 to the organizer online from the day of the auction until the end of the next working day.

– Էլեկտրոնային աճուրդի հաղթող մասնակիցն ստորագրված արձանագրությունն ու Հայաստանի Հանրապետության կառավարության 2023 թվականի սեպտեմբերի 28-ի N 1667-Ն որոշմամբ սահմանված հավելվածի 22-րդ կետում նշված փաստաթղթերը, աճուրդի կայացման օրվանից մինչև հաջորդ աշխատանքային օրվա ավարտը, առցանց եղանակով փոխանցում է կազմակերպչին:

The winning participant of the electronic auction shall transfer the lot price in full within three working days after signing the protocol, by crediting the advance payment to the account number 900105201363.

Էլեկտրոնային աճուրդի հաղթող մասնակիցը պարտավոր է արձանագրությունն ստորագրելուց հետո երեք աշխատանքային օրվա ընթացքում փոխանցել լոտի գինն ամբողջությամբ՝ հաշվանցելով նախավճարը՝ 900105201363 հաշվեհամարին։

* The auction organizer returns the advance payment to the unsuccessful participants in the auction within 3 business days from the date of the auction being held or declared void to the account holder specified in the application for participation.

* Աճուրդի կազմակերպիչը նախավճարը, աճուրդը կայանալուց կամ չկայացած հայտարարվելու պահից 3 աշխատանքային օրվա ընթացքում, վերադարձնում է աճուրդում չհաղթած մասնակիցներին՝ մասնակցության հայտում նշված հաշվետիրոջ հաշվեհամարին։

* In case of a technical malfunction (failure) of the system, the conduct of electronic auctions may be suspended until the technical malfunctions are eliminated, about which the auction organizer informs the auction participants of the given lot via e-mail or telephone message. In case of each technical malfunction, a report is drawn up on the causes of the malfunction and it is placed in the electronic log. The conclusion of the person servicing the system is submitted along with the report. After the technical malfunctions are eliminated, the electronic auction continues under the conditions stipulated by this public notice.

* Համակարգի տեխնիկական անսարքության (ձախողման) դեպքում էլեկտրոնային աճուրդների անցկացումը կարող է կասեցվել մինչև տեխնիկական անսարքությունների վերացումը, որոնց մասին աճուրդի կազմակերպիչը տեղեկացնում է տվյալ լոտի աճուրդի մասնակիցներին՝ էլեկտրոնային փոստի կամ հեռախոսային հաղորդագրության միջոցով։ Յուրաքանչյուր տեխնիկական անսարքության դեպքում կազմվում է տեղեկանք անսարքության պատճառների մասին և այն տեղադրվում է էլեկտրոնային մատյանում։ Տեղեկանքին կից ներկայացվում է համակարգն սպասարկող անձի եզրակացությունը։ Տեխնիկական անսարքությունները վերացնելուց հետո էլեկտրոնային աճուրդը շարունակվում է սույն հրապարակային ծանուցմամբ նախատեսված պայմաններով։

* According to the Resolution of the Government of the Republic of Armenia No. 1667-N of September 28, 2023 and the Resolution of the Abovyan Community Council No. 116-A of July 10, 2026:

* Համաձայն ՀՀ կառավարության 2023 թվականի սեպտեմբերի 28-ի N 1667-Ն որոշման և Աբովյան համայնքի ավագանու 2026 թվականի հուլիսի 10-ի թիվ 116-Ա որոշման՝

– The auction will be held electronically (with price increase).

– Աճուրդը կանցկացվի Էլեկտրոնային (գնի ավելացման) եղանակով։

– The person recognized as the winner of the auction is obliged to pay the price of the lot (lots) within 3 days from the date of signing the protocol.

– Աճուրդում հաղթող ճանաչված անձն արձանագրությունը ստորագրելու օրվանից 3 օրվա ընթացքում պարտավոր է վճարել լոտի (լոտերի) գինը։

– The winning participant of the electronic auction is obliged to transfer the amount intended for determining the value of the property to the account number 900105201363 within three working days after signing the protocol, necessarily indicating the address of the alienated property (indicating the address of the property) for the service of determining the value.

– Էլեկտրոնային աճուրդի հաղթող մասնակիցը պարտավոր է արձանագրությունն ստորագրելուց հետո երեք աշխատանքային օրվա ընթացքում փոխանցել գույքի արժեքի որոշման համար նախատեսված գումարը փոխանցել 900105201363 հաշվեհամարին՝ պարտադիր նշելով օտարվող գույքի հասցեի (նշելով գույքի հասցեն) որոշման արժեքի ծառայության համար։

– After payment of the price offered by the auction winner, as well as the amount of money intended for determining the value of the property (including value added tax), an alienation contract will be concluded with the buyer in accordance with the legislation of the Republic of Armenia, stipulating that the buyer undertakes to pay at his own expense the amounts and fees prescribed by law for notarial certification of the contract and state registration of property rights.

– Աճուրդի հաղթողի կողմից առաջարկված գնի, ինչպես նաև գույքի արժեքի որոշման համար նախատեսված գումարի արժեքի (ներառյալ՝ ավելացված արժեքի հարկը) վճարումից հետո Հայաստանի Հանրապետության օրենսդրության համաձայն գնորդի հետ կկնքվի օտարման պայմանագիր՝ նախատեսելով, որ գնորդը պարտավորվում է իր միջոցների հաշվին վճարել պայմանագրի նոտարական վավերացման և գույքային իրավունքների պետական գրանցման համար օրենքով սահմանված գումարներն ու տուրքերը:

– In case of failure to make payments by the auction winner within the specified period, the advance payment paid shall not be refunded, the auction shall be considered null and void and a new auction shall be organized to sell the lot(s) under the same conditions.

– Աճուրդի հաղթողի կողմից սահմանված ժամկետում վճարումները չկատարելու դեպքում մուծված նախավճարը չի վերադարձվում, աճուրդը համարվում է չկայացած և լոտ (եր)-ը վաճառելու նպատակով կազմակերպվում է նոր աճուրդ՝ նույն պայմաններով։

Article 9 of the Law “On Public Auctions”:

«Հրապարակային սակարկությունների մասին» օրենքի 9-րդ հոդված․

1. The conditions and information specified in the public notice of the auction shall not be subject to change, except in cases where changes have occurred in the restrictions on the lot to be sold at auction or changes have occurred in connection with the physical condition of the lot, or the possibility of changes has been provided for in the public notice of the auction.

1. Այն պայմանները և տեղեկությունները, որոնք նշվել են աճուրդի մասին հրապարակային ծանուցման մեջ, ենթակա չեն փոփոխման, բացառությամբ այն դեպքերի, երբ փոփոխություններ են տեղի ունեցել աճուրդով վաճառվելիք լոտի նկատմամբ սահմանափակումների մասով կամ փոփոխություններ են տեղի ունեցել` կապված լոտի ֆիզիկական վիճակի հետ, կամ աճուրդի մասին հրապարակային ծանուցման մեջ նախատեսվել է փոփոխությունների հնարավորությունը:

In the case provided for in this part, the auction organizer shall be obliged to make changes and additions to the public notice of the auction (hereinafter referred to as the change to the public notice) within the preceding three days in the same manner as the public notice of the auction was made.

Սույն մասով նախատեսված դեպքում աճուրդի կազմակերպիչը պարտավոր է մինչև նախորդող երեք օրը կատարել աճուրդի մասին հրապարակային ծանուցման փոփոխություններ և լրացումներ (այսուհետ` հրապարակային ծանուցման փոփոխություն) այն ձևով, ինչպես կատարվել էր աճուրդի մասին հրապարակային ծանուցումը:

2. If the change to the public notice is not made in the cases and in the manner provided for in part 1 of this Article, the auction organizer shall bear the risk of actual losses incurred by the participants.

2. Եթե հրապարակային ծանուցման փոփոխությունը չի կատարվել սույն հոդվածի 1-ին մասով նախատեսված դեպքերում և կարգով, ապա աճուրդի կազմակերպիչը կրում է մասնակիցների կրած իրական վնասների ռիսկը:

3. After the public notice of the auction has been issued, it is permitted to make any additions by amending the public notice, provided that the essential conditions specified in the public notice of the auction are not changed.

3. Աճուրդի մասին հրապարակային ծանուցում կատարելուց հետո թույլատրվում է հրապարակային ծանուցման փոփոխությամբ կատարել ցանկացած լրացում, եթե դրանով չեն փոփոխվում աճուրդի մասին հրապարակային ծանուցման մեջ նշված էական պայմանները:

Article 283 of the Criminal Code:

Քրեական օրենսգրքի 283 հոդված․

1. Violating the procedure for conducting public auctions or procurements or becoming the winner of a public auction or procurement by entering into an illegal agreement with another person, causing large-scale property damage to the owner of the property, the organizer of auctions, procurements, the buyer, the rights, freedoms or legitimate interests of another economic entity, person or organization, or the legitimate interests of society or the state, by fraud or in any other illegal manner,

1. Հրապարակային սակարկությունների կամ գնումների անցկացման կարգը խախտելով կամ մեկ այլ անձի հետ անօրինական համաձայնության գալով հրապարակային սակարկության կամ գնումների հաղթող դառնալով, խաբեությամբ կամ ապօրինի այլ եղանակով գույքի սեփականատիրոջը, սակարկություններ, գնումներ կազմակերպողին, գնորդին, այլ տնտեսավարող սուբյեկտի, անձի կամ կազմակերպության իրավունքներին, ազատություններին կամ օրինական շահերին կամ հասարակության կամ պետության օրինական շահերին խոշոր չափերի գույքային վնաս պատճառելը՝

shall be punishable by a fine in the amount of ten to thirty times the minimum wage, or by community service for a term of one hundred to two hundred hours, or by deprivation of the right to hold certain positions or engage in certain activities for a term of two to five years, or by restriction of liberty for a term of up to three years, or by short-term imprisonment for a term of up to two months, or by imprisonment for a term of up to three years.
