According to rumors, the government’s favorite candidate is Vladimir Vardanyan, a former deputy of the ruling party and now a judge of the Constitutional Court.

Լուսինե Հակոբյանը հիշեցնում է, որ Վլադիմիր Վարդանյանը, լինելով իշխող քաղաքական ուժի անդամ, ժամանակին դեմ է արտահայտվել դատական համակարգի արմատական վեթինգին։

Lusine Hakobyan, head of the “Europe of Law” NGO and human rights activist, strongly criticized this scenario on Factor TV, arguing that Vardanyan should not be elected to that position.

Lusine Hakobyan recalls that Vladimir Vardanyan, being a member of the ruling political force, once spoke out against the radical vetting of the judiciary.

Հիշում ենք բոլորս նրա վերաբերմունքը, երբ քաղաքացիական հասարակությունը տարիներ շարունակ պահանջում էր վեթինգ իրականացնել… մինչև հիմա հիշում եմ «Ազատություն» ռադիոկայանին տված հարցազրույցը, որտեղ նա ասաց, որ Հայաստանը վուլգար վեթինգի ճանապարհով չի գնա, և, ըստ էության, վեթինգի տապալման պատասխանատուներից մեկը նա էր»,- նշում է իրավապաշտպանը։

“He has not shown himself to be a worthy part of such a revolutionary government before.

Նրա խոսքով՝ ինքնին սխալ էր քաղաքական ուժի ներկայացուցչին դատավոր դարձնելը, և հիմա էլ ՍԴ դատավորները չպետք է կրկնեն այդ սխալը։

We all remember his attitude when civil society demanded for years to implement vetting… I still remember the interview he gave to Radio Liberty, where he said that Armenia would not follow the path of vulgar vetting, and, in fact, he was one of those responsible for the failure of vetting,” the human rights activist notes.

Հակոբյանն այս իրավիճակը համեմատում է նախկին իշխանությունների օրոք տեղի ունեցածի հետ.

According to him, it was a mistake in itself to make a representative of a political force a judge, and now the judges of the Constitutional Court should not repeat that mistake.

«Իշխող կուսակցությունը իր կազմից գործուղել էր Հրայր Թովմասյանին որպես ՍԴ նախագահ… Հիմա կարծում եմ համանման իրավիճակ է այն տարբերությամբ, որ հիմա դատավորներն են ընտրելու»։

Hakobyan compares this situation with what happened during the previous government.

Իրավապաշտպանը հորդորում է ՍԴ դատավորներին դրսևորել «մաքսիմալ աչալրջություն և զգոն լինել Սահմանադրական դատարանի հեղինակության հարցի նկատմամբ»՝ ձեռնպահ մնալով Վարդանյանին ընտրելուց։

“The ruling party had seconded Hrayr Tovmasyan from its ranks as the chairman of the Constitutional Court… Now I think it is a similar situation with the difference that now the judges will elect him.”

Նա հավելում է, որ ՍԴ-ում կան արժանի այլ թեկնածուներ: Անդրադառնալով իշխանության կադրային քաղաքականությանը և վարչապետի վերջին դժգոհություններին դատաիրավական համակարգից՝ Հակոբյանը նկատում է, որ իշխանությունն ինքն է նախընտրել հավատարիմ կադրերի նշանակումը՝ պրոֆեսիոնալների փոխարեն։

The human rights activist urges the judges of the Constitutional Court to show “maximum vigilance and be vigilant regarding the issue of the authority of the Constitutional Court” by refraining from electing Vardanyan.

He adds that there are other worthy candidates in the Constitutional Court.

Աշխատում է պրոֆեսիոնալիզմը… Թերևս, դժվար է խիստ պրոֆեսիոնալ մարդուն ստիպել, որ ինքը ինչ-որ մի որոշում կայացնի զանգով… Եթե չենք կարողանում բարեփոխել, ապա մերոնք գոնե լինեն։

Referring to the government’s personnel policy and the Prime Minister’s recent complaints about the judicial system, Hakobyan notes that the government itself has preferred to appoint loyal personnel instead of professionals.

“The loyalty attribute does not work.

Իսկ չեն կարողանում բարեփոխել, որովհետև Նիկոլ Փաշինյանն է ամբողջ օրը բողոքում դատաիրավական համակարգից»,- ասում է նա։

Professionalism does work… Perhaps, it is difficult to force a strictly professional person to make a decision on a call… If we cannot reform, then at least ours should be.

Անդրադառնալով վարչապետի նոր նախագծին՝ Սահմանադրությամբ բոլոր դատավորներին ժամանակավոր պաշտոնակատար (ԺՊ) դարձնելուն և բարեվարքության ստուգումից հետո միայն նշանակելուն, Լուսինե Հակոբյանը նշում է, որ որպես այդպիսին, դա վատ գաղափար չէ։

Referring to the Prime Minister’s new project to make all judges temporary acting (TA) and appoint them only after a check on their good conduct, Lusine Hakobyan notes that as such, it is not a bad idea.

Ըստ նրա, եթե հարցը լուծվելու է զուտ նախկինում կուսակցական լինել-չլինելու սկզբունքով, ապա նորմալ համակարգ չի ստեղծվի: Հարցազրույցն ամբողջությամբ՝ տեսանյութում։

However, the main problem remains the issue of those implementing the process.

“But we come back to the question of who will conduct that vetting, what kind of study will be conducted, will it be possible to study the judicial acts made by those judges, for example…” According to him, if the issue is resolved purely on the principle of whether or not they were previously party members, then a normal system will not be created.
