CCBE responds to the Chamber of Advocates' request regarding the rights of lawyer Yerem Sargsyan

The statement of the Chamber of Advocates of the Republic of Armenia is below: “The Chamber of Advocates of the Republic of Armenia had applied to the CCBE regarding the exemption of Yerem Sargsyan from participating in the proceedings, the summoning of him to be questioned as a witness in the same proceedings and the request for information subject to legal privilege.

ՀՀ փաստաբանների պալատի հաղորդագրությունը՝ ստորև․ «ՀՀ փաստաբանների պալատը CCBE-ին դիմել էր Երեմ Սարգսյանին վարույթին մասնակցելուց ազատելու, նույն վարույթով որպես վկա հարցաքննության հրավիրելու և փաստաբանական գաղտնիք պարունակող տեղեկություններ պահանջելու կապակցությամբ։

According to the Chamber, the CCBE noted in its message to the competent authorities that lawyers should be able to provide legal assistance independently and without undue interference, regardless of the nature of the proceedings, the identity of the client or the specifics of the case.

Պալատի հաղորդմամբ՝ CCBE-ն իրավասու մարմիններին ուղղված ուղերձում նշել է, որ փաստաբանները պետք է կարողանան իրավաբանական օգնություն տրամադրել անկախ և առանց անհարկի միջամտության՝ անկախ վարույթի բնույթից, վստահորդի ինքնությունից կամ գործի առանձնահատկություններից։

The CCBE particularly emphasized the importance of this principle in criminal proceedings, noting that the effective exercise of the right of defense is an important component of the right to a fair trial.

CCBE-ն հատկապես ընդգծել է այս սկզբունքի նշանակությունը քրեական վարույթներում՝ նշելով, որ պաշտպանության իրավունքի արդյունավետ իրականացումն արդար դատաքննության իրավունքի կարևոր բաղադրիչ է։

The Council also called for ensuring that lawyers can perform their professional duties without pressure, obstruction or undue interference, and that information acquired in the course of their professional activities is protected as a matter of professional privilege.

Խորհուրդը նաև կոչ է արել ապահովել, որ փաստաբանները կարողանան իրենց մասնագիտական պարտականություններն իրականացնել առանց ճնշման, խոչընդոտման կամ անպատշաճ միջամտության, իսկ մասնագիտական գործունեության ընթացքում նրանց հայտնի դարձած տեղեկությունները պահպանվեն որպես փաստաբանական գաղտնիք։

The CCBE also reiterated its call on Armenia to sign and ratify, as a matter of priority, the Council of Europe Convention on the Protection of the Profession of Lawyer.
