Statement from Gagik Khachatryan's legal team regarding paintings seized from the former official's home

On October 7, 2026, the Investigative Committee of the Republic of Armenia announced that the 70 paintings seized from Gagik Khachatryan will now be available to the public. The Chairman of the Investigative Committee, the Minister of Education, Culture and Sports and the Prosecutor General visited the National Gallery and issued a statement, which stated the following: The heads of departments on site got acquainted with the exhibition of paintings seized from the former Chairman of the State Revenue Committee and former Minister of Finance Gagik Khachatryan within the framework of the criminal proceedings, which were transferred to the National Gallery of Armenia SNCO as a result of investigative actions.

2026 թվականի հոկտեմբերի 7-ին ՀՀ քննչական կոմիտեն Գագիկ Խաչատրյանից առգրավված 70 կտավներն այսուհետ հասանելի կդառնան հանրությանը․ Քննչական կոմիտեի նախագահը, ԿԳՄՍ նախարարը և գլխավոր դատախազն այցելել են Ազգային պատկերասրահ վերնագրով հաղորդագրություն է տարածել, որում նշվել է հետևյալը․ Գերատեսչությունների ղեկավարները տեղում ծանոթացել են քրեական վարույթի շրջանակում ՊԵԿ նախկին նախագահ և ֆինանսների նախկին նախարար Գագիկ Խաչատրյանից առգրավված կտավների ցուցադրությունը, որոնք քննչական գործողությունների արդյունքում ի պահ են հանձնվել Հայաստանի ազգային պատկերասրահ ՊՈԱԿ-ին։

These cultural values will now be open to the public.

It should be recalled that a total of 70 paintings seized and examined in the criminal proceedings against Gagik Khachatryan were recognized as evidence by a decision made on September 11, 2026 and were transferred to the National Gallery for safekeeping.

Հիշեցնենք, որ Գագիկ Խաչատրյանի վերաբերյալ քննվող քրեական վարույթով առգրավված և զննված ընդհանուր՝ 70 կտավներ, 2026 թվականի սեպտեմբերի 11-ին կայացված որոշմամբ ճանաչվել են ապացույց և ի պահ են հանձնվել Ազգային պատկերասրահին։

The Khachatryan lawyers' group expresses serious concern about such obvious illegal actions of the preliminary investigation body.

Խաչատրյանների փաստաբանական խումբը խիստ մտահոգություն է հայտնում նախաքննական մարմնի նման ակնհայտ ապօրինի գործողությունների վերաբերյալ։

In particular, these actions are not only clearly unlawful and not only grossly violate the property rights of the owners of these paintings, guaranteed by the Constitution of the Republic of Armenia, but also clearly violate their right to privacy.

Մասնավորապես, այս գործողությունները ոչ միայն ակնհայտ ոչ իրավաչափ են և ոչ միայն կոպիտ կերպով խախտում են այդ կտավների սեփականատերերի՝ ՀՀ Սահմանադրությամբ երաշխավորված սեփականության իրավունքը, այլև ակնհայտորեն ոտնահարում են նրանց մասնավոր, անձնական կյանքի գաղտնիության իրավունքը։

In this context, first of all, we would like to inform you that the information that all these paintings were seized from Gagik Khachatryan is not true, since they were seized from an apartment belonging to the Khachatryans, in which paintings belonging to numerous family members, including those dedicated to them at different times, were found, the seizure of which is also clearly illegal.

Այս համատեքստում նախևառաջ ցանկանում ենք տեղեկացնել, որ իրականությանը չեն համապատասխանում այն տվյալները, թե իբրև այդ բոլոր կտավներն առգրավվել են Գագիկ Խաչատրյանից, քանի որ դրանք առգրավվել են Խաչատրյաններին պատկանող բնակարանից, որում գտնվել են ընտանիքի բազմաթիվ անդամներին պատկանող, այդ թվում՝ տարբեր ժամանակահատվածներում նրանց նվիրված կտավներ, որոնց առգրավումը ևս ակնհայտ անօրինական է։

In addition, the body conducting the proceedings has not yet attempted to obtain a single explanation from Khachatryans regarding the origin of the paintings and their legality.

Բացի այդ, վարույթն իրականացնող մարմինը մինչ այս պահը այդ կտավների ծագման և դրանց օրինականության վերաբերյալ գեթ մեկ պարզաբանում չի փորձել ստանալ Խաչատրյաններից։

Moreover, although the body conducting the proceedings has illegally deprived the owners of the paintings of the right to freely dispose of, possess, and use their property, the decision to recognize the paintings as physical evidence and to deposit them with the National Gallery has not yet been provided to the owners of the paintings or their lawyers.

Ավելին՝ չնայած, որ վարույթն իրականացնող մարմինն անօրինական կերպով կտավների սեփականատերերին զրկել է իրենց սեփականությունն անարգել տնօրինելու, տիրապետելու և օգտագործելու իրավունքից, սակայն մինչ այս պահը կտավների սեփականատերերին կամ նրանց փաստաբաններին չեն տրամադրել այդ կտավները որպես իրեղեն ապացույց ճանաչելու և դրանք Ազգային պատկերասրահին ի պահ հանձնելու մասին որոշումը։

And this is despite the fact that the law clearly stipulates that if the body conducting the proceedings cannot keep the physical evidence, then it is primarily returned or deposited with their legal owners.

Եվ դա այն դեպքում, որ օրենքը հստակ նախատեսում է, որ եթե իրեղեն ապացույցները վարույթն իրականացնող մարմինը չի կարող պահել իր մոտ, ապա դրանք առաջնահերթ կարգով վերադարձվում կամ ի պահ են հանձնվում հենց դրանց օրինական տիրապետողներին։

At the same time, the law strictly prohibits the use of property seized within the framework of criminal proceedings that is the property of other persons by the body conducting the proceedings or others, therefore, their public display by the National Gallery is strictly prohibited by law, as well as violates the right to property and privacy of their owners.

Միաժամանակ, օրենքը խստիվ արգելում է քրեական վարույթի շրջանակներում առգրավված՝ այլ անձանց սեփականություն հանդիսացող գույքի օգտագործումը վարույթն իրականացնող մարմնի կամ այլոց կողմից, ուստի դրանք Ազգային պատկերասրահի կողմից բաց ցուցադրության դնելը խստորեն արգելված է օրենքով, ինչպես նաև խախտում է դրանց սեփականատերերի սեփականության և մասնավոր կյանքի գաղտնիության իրավունքը։

Moreover, their display by the body conducting the proceedings, rather than their safekeeping, in itself indicates that these paintings were not and cannot be material evidence in this criminal case, as claimed by the defense, and their seizure pursued only such an illegal purpose.

Ավելին, վարույթն իրականացնող մարմնի կողմից դրանց ցուցադրությունը, այլ ոչ թե անվնաս պահպանությունն ինքնին վկայում է այն մասին, որ այդ կտավները չեն եղել և չեն կարող սույն քրեական գործով որպես իրեղեն ապացույց լինել, ինչպես և պնդել է պաշտպանության կողմը և դրանց առգրավումն միայն նման անօրինական նպատակ է հետապնդել։

If there is a need for this, the Khachatryans can personally organize the public display of these paintings, and the actions of the body conducting the proceedings must proceed exclusively from the law.

Եթե դրա անհրաժեշտությունն առկա է, ապա Խաչատրյաններն անձամբ կարող են կազմակերպել այդ կտավների բաց ցուցադրությունը, իսկ վարույթ իրականացնող մարմնի գործողությունը պետք է բխեն բացառապես օրենքից։

It should be noted that a written request has been sent to the Investigative Committee of the Republic of Armenia for the purpose of clarifying all these issues, and after receiving the response, we will make an additional statement on this issue, if necessary.

Նշենք, որ այս բոլոր հարցերի պարզաբանման նպատակով գրավոր հարցում է ուղարկվել ՀՀ քննչական կոմիտե և պատասխանը ստանալուց հետո, ըստ անհրաժեշտության, այս հարցի կապակցությամբ հանդես կգանք լրացուցիչ հայտարարությամբ։

It should be noted that the Investigative Committee had earlier reported that a total of 70 paintings seized and examined in the criminal proceedings against Gagik Khachatryan will be exhibited at the National Gallery.

Հիշեցնենք՝ Քննչական կոմիտեն ավելի վաղ հաղորդել էր, որ Գագիկ Խաչատրյանի վերաբերյալ քննվող քրեական վարույթով առգրավված և զննված ընդհանուր 70 կտավներ կցուցադրվեն Ազգային պատկերասրահում։
