Some of the paintings attributed to Gagik Khachatryan, former Chairman of the State Revenue Committee of the Republic of Armenia, former Minister of Finance, belonged to other family members, which were received as a gift.

The right to property and the privacy of the private life of the Khachatryan family members guaranteed by the Constitution was violated.

Khachatryan’s advocacy group issued a statement about this.

Ավելի վաղ հայտնել էինք, որ Գագիկ Խաչատրյանից առգրավված 70 կտավներն այսուհետ հասանելի կդառնան հանրությանը․ քննչական կոմիտեի նախագահը, ԿԳՄՍ նախարարը և գլխավոր դատախազն այսօր այցելել էին Ազգային պատկերասրահ և ծանոթացել քրեական վարույթի շրջանակում առգրավված կտավների ցուցադրությունը, որոնք քննչական գործողությունների արդյունքում ի պահ են հանձնվել «Հայաստանի ազգային պատկերասրահ» ՊՈԱԿ-ին։

The lawyers described the actions of the preliminary investigation body as illegal.

Փաստաբանները շեշտել են, որ վարույթն իրականացնող մարմինը մինչ օրս Խաչատրյան ընտանիքից չեն փորձել կտավների ծագման և դրանց օրինականության վերաբերյալ պարզաբանում ստանալ։

Earlier, we reported that the 70 paintings seized from Gagik Khachatryan will now be available to the public.

The Chairman of the Investigative Committee, the Minister of Education, Culture and Sports and the Prosecutor General visited the National Gallery today and got acquainted with the exhibition of paintings seized within the framework of the criminal proceedings, which were transferred to the “National Gallery of Armenia” SNCO as a result of investigative actions.

Նրանք հիշեցրել են օրենքի պահանջը, որ, եթե իրեղեն ապացույցները վարույթն իրականացնող մարմինը չի կարող պահել իր մոտ, ապա դրանք առաջնահերթ կարգով վերադարձվում կամ ի պահ են հանձնվում հենց դրանց օրինական տիրապետողներին։

The lawyers emphasized that the body conducting the proceedings has not yet tried to obtain clarification from the Khachatryan family regarding the origin of the paintings and their legality.

«Միաժամանակ, օրենքը խստիվ արգելում է քրեական վարույթի շրջանակներում առգրավված՝ այլ անձանց սեփականություն հանդիսացող գույքի օգտագործումը վարույթն իրականացնող մարմնի կամ այլոց կողմից, ուստի դրանք Ազգային պատկերասրահի կողմից բաց ցուցադրության դնելը խստորեն արգելված է օրենքով, ինչպես նաև խախտում է դրանց սեփականատերերի սեփականության և մասնավոր կյանքի գաղտնիության իրավունքը։

According to the lawyers, the body conducting the proceedings did not provide the owners of the paintings with the decision to recognize them as physical evidence and to deposit them with the National Gallery.

Ավելին` վարույթն իրականացնող մարմնի կողմից դրանց ցուցադրությունը, այլ ոչ թե անվնաս պահպանությունն ինքնին վկայում է այն մասին, որ այդ կտավները չեն եղել և չեն կարող սույն քրեական գործով որպես իրեղեն ապացույց լինել»,– մանրամասնել են

They recalled the requirement of the law that if the body conducting the proceedings cannot keep the physical evidence with itself, then they are returned or deposited with their legal owners as a priority.

Moreover, their display by the body conducting the proceedings, rather than their safekeeping, itself indicates that these paintings were not and cannot be material evidence in this criminal case,” they detailed.

Խաչատրյանը մեղադրվում է առանձնապես խոշոր չափերով կաշառք ստանալու և առանձնապես խոշոր չափերով փողերի լվացման մեջ, ինչ առթիվ նախաձեռնվել է քրեական վարույթ: Գործի շրջանակում անհետաձգելի քննչական և վարութային գործողություններ են իրականացվել Խաչատրյանի, նրա որդու բնակարաններում, ինչպես նաև նրանց հետ փոխկապակցված շուրջ 21 ընկերության գրասենյակներում և մասնաճյուղերում։

Khachatryan’s legal team sent a written request to the Investigative Committee of the Republic of Armenia to clarify all issues.

Let us recall that on September 1, Gagik Khachatryan, the former chairman of the State Revenue Committee of the Republic of Armenia, was arrested.

Masked NSS officers took him out of his house on a stretcher while he was lying down, then transported him by ambulance to the detention center, where a motion was filed to detain him.

As a result, on August 2, he was detained for 2 months.

Khachatryan is accused of receiving a bribe in a particularly large amount and laundering money in a particularly large amount, on which criminal proceedings have been initiated.

Within the framework of the case, urgent investigative and procedural actions were carried out in the apartments of Khachatryan and his son, as well as in the offices and branches of about 21 companies affiliated with them.
