MEPs have recorded problems at the "Shirak Child Care Center"

Upon the instruction of the Human Rights Defender Anahit Manasyan, the representatives of the Human Rights Defender conducted an unannounced monitoring visit to the “Shirak Child Care Center” State Non-Profit Organization of the Ministry of Labor and Welfare of the Republic of Armenia (hereinafter referred to as the Institution).

Մարդու իրավունքների պաշտպան Անահիտ Մանասյանի հանձնարարությամբ ՄԻՊ ներկայացուցիչները չհայտարարված մշտադիտարկման այց են իրականացրել ՀՀ աշխատանքի և բարեկեցության նախարարության «Շիրակի երեխայի խնամքի կենտրոն» պետական ոչ առևտրային կազմակերպություն (այսուհետ՝ նաև Հաստատություն):

During the visit, the building, sanitary and hygienic conditions of the Institution, issues related to the provision of care, medical care, food, relations between the Institution’s staff and beneficiaries, the state of protection of their rights and interests, documents, and their compliance with the established requirements and applicable standards were examined.

Այցի ընթացքում ուսումնասիրվել են Հաստատության շենքային, սանիտարահիգիենիկ պայմանները, խնամքի, բժշկական օգնության, սննդի տրամադրման հետ կապված հարցերը, Հաստատության աշխատակազմի և շահառուների միջև հարաբերությունները, նրանց իրավունքների և շահերի պաշտպանության վիճակը, փաստաթղթերը, դրանց համապատասխանությունը սահմանված պահանջներին ու կիրառելի չափորոշիչներին:

The problems recorded in the Institution are mainly systemic.

Հաստատությունում արձանագրված խնդիրները, հիմնականում, համակարգային են։

In particular, due to the insufficient space allocated to the Institution, the requirements for the living area were not met, which resulted in beds being connected to each other or placed too close to each other in the bedrooms, and the necessary personal space for the beneficiaries was not provided. At the same time, due to the structural features of the bathrooms and toilets, the necessary conditions for meeting the personal hygiene requirements of the beneficiaries in separate conditions were not provided.

Մասնավորապես՝ հաստատությանը հատկացված ոչ բավարար տարածքի պատճառով պահպանված չէին բնակելի մակերեսի համար նախատեսված պահանջները, ինչով պայմանավորված` ննջասենյակներում առկա էին իրար միացված կամ շատ մոտ տեղադրված մահճակալներ, ապահովված չէր շահառուների համար անհրաժեշտ անձնական տարածքը։ Միաժամանակ, սանհանգույցների և լոգարանների կառուցվածքային առանձնահատկություններով պայմանավորված՝ ապահովված չէին շահառուների անձնական հիգիենայի պահանջներն առանձնացված պայմաններում բավարարելու համար անհրաժեշտ պայմանները։

The physical environment of the institution did not comply with the principles of universal design, there was a need to ensure reasonable accommodations.

Հաստատության ֆիզիկական միջավայրը չէր համապատասխանում համընդհանուր դիզայնի սկզբունքներին, առկա էր խելամիտ հարմարեցումների ապահովման անհրաժեշտություն։

The representatives of the Defender's staff discussed the above and other recorded issues with the institution's management.

Վերոնշյալ և արձանագրված այլ խնդիրները Պաշտպանի աշխատակազմի ներկայացուցիչները քննարկել են հաստատության տնօրինության հետ:

The document reflecting the issues, along with proposals aimed at solving them, will be submitted to the competent authorities in the field.

Խնդիրներն արտացոլող փաստաթուղթը` դրանց լուծմանն ուղղված առաջարկների հետ մեկտեղ, կներկայացվի ոլորտի իրավասու մարմիններին:

During the visit, the management and staff of the Institution effectively cooperated with the representatives of the Defender's staff. At the same time, within the framework of the discussions and recorded issues during the visit, the continuation of further work towards their resolution was emphasized.

Այցի ընթացքում Հաստատության տնօրինությունը և անձնակազմն արդյունավետ համագործակցել են Պաշտպանի աշխատակազմի ներկայացուցիչների հետ: Միաժամանակ, այցի ընթացքում քննարկումների և արձանագրված հարցերի շրջանակում կարևորվել է դրանց լուծման ուղղությամբ հետագա աշխատանքների շարունակականությունը։

The Human Rights Defender, as an official monitoring the implementation of the provisions of the UN Convention on the Rights of Persons with Disabilities, specifically emphasizes the need for the state to take effective steps towards the deinstitutionalization of 24-hour care facilities for persons with disabilities, implement structural reforms, and adopt a systematic approach.

Մարդու իրավունքների պաշտպանը՝ որպես «Հաշմանդամություն ունեցող անձանց իրավունքների մասին» ՄԱԿ-ի կոնվենցիայի դրույթների կիրառության մշտադիտարկում իրականացնող պաշտոնատար անձ, հատուկ ընդգծում է պետության կողմից հաշմանդամություն ունեցող անձանց շուրջօրյա խնամքի հաստատությունների ապաինստիտուցիոնալացման ուղղությամբ գործուն քայլեր ձեռնարկելու, կառուցվածքային բարեփոխումներ իրականացնելու և համակարգված մոտեցում որդեգրելու անհրաժեշտությունը:
