Anna Vardapetyan presented the challenges and solutions for the return of illegal assets from abroad at the meeting of the CIS Prosecutors General

The Prosecutor General's Office reports that within the framework of the first issue on the agenda, Prosecutor General of the Republic of Armenia Anna Vardapetyan made a speech on the topic "Modern Challenges and New Solutions in the Field of Return of Illegal Assets from Abroad".

Դատախազությունից հայտնում են, որ օրակարգի առաջին հարցի շրջանակում ՀՀ գլխավոր դատախազ Աննա Վարդապետյանը հանդես է եկել «Ժամանակակից մարտահրավերներն ու նոր լուծումները արտերկրից ապօրինի գույքի վերադարձի ոլորտում» թեմայով ելույթով։

Anna Vardapetyan noted that the cross-border nature of modern crime creates new challenges for states: illegally acquired assets (property) can be moved to different countries, registered in the names of related persons and transformed into other types of property.

Աննա Վարդապետյանը նշել է, որ ժամանակակից հանցավորության անդրսահմանային բնույթը նոր մարտահրավերներ է ստեղծում պետությունների համար․ ապօրինի ճանապարհով ձեռք բերված ակտիվները (գույքերը) կարող են տեղափոխվել տարբեր երկրներ, գրանցվել փոխկապակցված անձանց անունով և վերափոխվել գույքի այլ տեսակների։

"In these conditions, the return of assets should be considered as a complex process, from their detection and tracing to freezing or seizure, judicial investigation, confiscation, management and actual return," the Prosecutor General of the Republic of Armenia emphasized and added that the impossibility of criminal prosecution should not automatically mean the impossibility of returning illegally acquired property. In this context, the Prosecutor General of the Republic referred to the mechanism of non-conviction based asset forfeiture.

«Այս պայմաններում ակտիվների վերադարձը պետք է դիտարկել որպես համալիր գործընթաց՝ դրանց հայտնաբերումից և հետագծումից մինչև սառեցում կամ առգրավում, դատական քննություն, բռնագանձում, կառավարում և փաստացի վերադարձ»,- ընդգծել է ՀՀ գլխավոր դատախազն ու հավելել, որ քրեական հետապնդման անհնարինությունը չպետք է ինքնաբերաբար նշանակի ապօրինի ճանապարհով ձեռք բերված գույքի վերադարձի անհնարինություն։ Այս համատեքստում հանրապետության գլխավոր դատախազն անդրադարձել է առանց մեղադրական դատավճռի ակտիվների բռնագանձման (non-conviction based asset forfeiture) մեխանիզմին։

Anna Vardapetyan presented the experience of Armenia, noting that with the adoption of the Law “On Confiscation of Illegally Acquired Assets” in 2020, a legal basis was formed for applying an independent civil law mechanism for the return of illegally acquired assets.

Աննա Վարդապետյանը ներկայացրել է Հայաստանի փորձը՝ նշելով, որ 2020 թվականին «Ապօրինի ծագում ունեցող գույքի բռնագանձման մասին» օրենքի ընդունմամբ ձևավորվել է իրավական հիմք՝ ապօրինի ձեռք բերված գույքի վերադարձի նկատմամբ ինքնուրույն քաղաքացիաիրավական մեխանիզմ կիրառելու համար։

In this context, emphasizing the effectiveness of international mutual legal assistance, the Prosecutor General of the Republic of Armenia emphasized that international cooperation should begin even at the stage of identifying and tracing the asset, enabling its prompt freezing, seizure and preservation until the end of the national judicial process.

Այս համատեքստում կարևորելով միջազգային իրավական փոխօգնության արդյունավետությունը՝ ՀՀ գլխավոր դատախազն ընդգծել է, որ միջազգային համագործակցությունը պետք է սկսվի դեռևս ակտիվի հայտնաբերման և հետագծման փուլում՝ հնարավոր դարձնելով դրա օպերատիվ սառեցումը, առգրավումը և պահպանությունը մինչև ազգային դատական գործընթացի ավարտը։

Anna Vardapetyan also referred to the significance of the Warsaw Convention of the Council of Europe and its Additional Protocol adopted in 2026, emphasizing that representatives of the Prosecutor General of the Republic of Armenia directly participated in the development of the Protocol.

Աննա Վարդապետյանն անդրադարձել է նաև Եվրոպայի խորհրդի Վարշավայի կոնվենցիայի և 2026 թվականին ընդունված դրա լրացուցիչ արձանագրության նշանակությանը՝ ընդգծելով, որ արձանագրության մշակմանն անմիջական մասնակցություն են ունեցել ՀՀ գլխավոր դատախազության ներկայացուցիչները։

The Prosecutor General of the Republic of Armenia also presented the problems arising during international cooperation related to the differences between the legal systems of different states, the absence of similar mechanisms for civil law confiscation, as well as the limitations on the further use of information obtained unofficially as evidence.

ՀՀ գլխավոր դատախազը ներկայացրել է նաև միջազգային համագործակցության ընթացքում առաջացող խնդիրները՝ կապված տարբեր պետությունների իրավական համակարգերի միջև առկա տարբերությունների, քաղաքացիաիրավական բռնագանձման համանման մեխանիզմների բացակայության, ինչպես նաև ոչ պաշտոնական եղանակով ստացված տեղեկատվության հետագա՝ որպես ապացույց օգտագործման սահմանափակումների հետ։

Anna Vardapetyan emphasized the importance of further development of international cooperation in this direction, highlighting the rapid exchange of information on assets, the improvement of mechanisms for the operational freezing and seizure of property, ensuring the possibility of international mutual legal assistance until the final court decision is made, the mutual recognition and enforcement of judicial acts, as well as the effective management of confiscated assets.

Աննա Վարդապետյանն այս ուղղությամբ կարևորել է միջազգային համագործակցության հետագա զարգացումը՝ առանձնացնելով ակտիվների վերաբերյալ տեղեկատվության արագ փոխանակումը, գույքի օպերատիվ սառեցման և առգրավման մեխանիզմների կատարելագործումը, միջազգային իրավական փոխօգնության հնարավորության ապահովումը՝ մինչև վերջնական դատական որոշման կայացումը, դատական ակտերի փոխադարձ ճանաչումն ու կատարումը, ինչպես նաև բռնագանձված ակտիվների արդյունավետ կառավարումը։

In conclusion, Anna Vardapetyan noted that today the return of assets is no longer just a matter of confiscation of property after the end of the criminal process.

Ամփոփելով՝ Աննա Վարդապետյանը նշել է, որ ակտիվների վերադարձն այսօր այլևս միայն քրեական գործընթացի ավարտից հետո գույքի բռնագանձման հարց չէ։

“This is a complex process that begins with the discovery of the asset, its location, tracking and ends with the actual return of the asset. "Our common goal is to ensure that a legal vacuum does not arise between the discovery of the asset and its actual return," the Prosecutor General of Armenia noted.

«Սա համալիր գործընթաց է, որը սկսվում է ակտիվի հայտնաբերումից, դրա գտնվելու վայրի տեղորոշումից, հետագծումից և ավարտվում ակտիվի փաստացի վերադարձով։ Մեր ընդհանուր նպատակն է ապահովել, որպեսզի ակտիվի հայտնաբերման և դրա փաստացի վերադարձի միջև իրավական վակուում չառաջանա»,- նշել է ՀՀ գլխավոր դատախազը։
