The Armenian SSR was renamed the Republic of Armenia

The first paragraph of the Declaration of Independence of Armenia of August 23, 1990 literally defines it: “The Armenian SSR is renamed the Republic of Armenia, abbreviated as Armenia.”

The existence of the state border of Armenia was also enshrined in an official legal act in the very first year of independence. On December 19, 1991, by decree of President Levon Ter-Petrosyan, the border territories along the state border of the Republic of Armenia were defined. The document literally mentions the state border of the Republic of Armenia with Iran, Turkey, Georgia and Azerbaijan (also Nakhichevan). The purpose of the decree was stated as ensuring “reliable protection of the state border of the republic”.

Did the Armenian SSR have borders?

Article 70 of the Constitution of the Armenian SSR (on June 25, 1989, the Supreme Council of the Armenian SSR restored the Armenian word “soviet” in the official name instead of “soviet”. Thus, the Armenian SSR became the Armenian SSR-ed.) adopted on April 14, 1978 also stipulated:

“The territory of the Armenian SSR cannot be changed without its consent. The borders between the Armenian SSR and other union republics may be changed by mutual consent of the corresponding republics, which is subject to approval by the Union of Soviet Socialist Republics.”

This provision shows that the Armenian SSR had a defined territory within the USSR, and had legally existing inter-republican borders with other union republics, in particular the Azerbaijani and Georgian SSRs.

The official justification submitted to the Turkish Parliament in 1974 states that the state border between the Republic of Turkey and the USSR was determined by the Moscow and Kars Treaties of 1921. Official NATO documents of 1968 also mention the Turkish-Soviet border demarcation protocol of February 28, 1967, the technical protocol attached to it, and the rules for the passage of persons participating in the redemarcation work, among the treaties related to USSR-Turkey relations.

Another confirmation of the existence of the border is in the UN Treaty Collection. The first article of the Protocol on the Border of Territorial Waters in the Black Sea, signed between Turkey and the USSR on April 17, 1973, states that the maritime border begins at the “end point of the land state border” between the USSR and the Republic of Turkey.

The Law “On State Border” adopted on November 20, 2001 defines: “The state border is the line and the vertical surface passing through that line that determine the boundaries of the territory of the Republic of Armenia: land, waters, subsoil, airspace.

The Constitutional Court of the Republic of Armenia, by its decision SDO-1749 of 2024, considers demarcation as a process of specifying interstate borders in geographical terms.

Հայաստանի և Վրաստանի միջև պետական սահմանի սահմանազատումը ևս ավարտված չէ։ 2019 թ․ ՀՀ ԱԳՆ խոսնակի հրապարակած տվյալներով՝ հայ-վրացական սահմանի 225 կմ-ից համաձայնեցված է 147 կմ-ն, իսկ մնացած՝ մոտ 78 կմ հատվածների համաձայնեցման աշխատանքները դեռ շարունակվում են։

Thus, the Republic of Armenia has state borders. Their existence does not depend on the completion of the demarcation process with all neighboring states. The corresponding sections of Armenia's borders with Turkey and Iran were international state borders during the USSR, while the former inter-republican borders with Azerbaijan and Georgia became the legal basis for borders between independent states after the collapse of the USSR.
Այսպիսով, ՀՀ-ն ունի պետական սահմաններ։ Դրանց գոյությունը կախված չէ հարևան բոլոր պետությունների հետ սահմանազատման գործընթացի ավարտից։ Հայաստանի՝ Թուրքիայի և Իրանի հետ սահմանների համապատասխան հատվածները դեռ ԽՍՀՄ տարիներին միջազգային պետական սահմաններ էին, իսկ Ադրբեջանի և Վրաստանի հետ նախկին միջհանրապետական սահմանները ԽՍՀՄ փլուզումից հետո դարձել են անկախ պետությունների միջև սահմանների իրավական հիմքը։
Armenian legislation also clearly defines the state border of the Republic of Armenia, and the Constitutional Court considers demarcation as a process of geographical adjustment of interstate borders. Therefore, the incompleteness of the demarcation processes with Azerbaijan and Georgia does not mean that the Republic of Armenia does not have state borders.
Հայաստանի օրենսդրությունը ևս հստակ սահմանում է ՀՀ պետական սահմանը, իսկ Սահմանադրական դատարանը սահմանազատումը դիտարկում է որպես միջպետական սահմանների աշխարհագրական ճշգրտման գործընթաց։ Հետևաբար, Ադրբեջանի և Վրաստանի հետ սահմանազատման գործընթացների չավարտված լինելը չի նշանակում, որ Հայաստանի Հանրապետությունը պետական սահմաններ չունի։
