The Ministry of Infrastructure is preparing amendments to public procurement legislation. The initiative aims to create a mechanism through which Georgian companies can gain a price advantage when participating in government tenders.

Министерство инфраструктуры готовит изменения в законодательство о госзакупках. Суть инициативы — создать механизм, при котором грузинские компании смогут получать ценовое преимущество при участии в государственных тендерах.

The Turkish experience is being considered as a possible model, where market participants estimate that such an advantage for local companies can reach 15%.

В качестве возможной модели рассматривается опыт Турции, где такое преимущество для местных компаний, по оценке участников рынка, может достигать 15%.

Why is this necessary? One of the main problems for local businesses is the lack of significant experience. To secure a major international contract, a company must demonstrate the completion of comparable projects. However, without major contracts, such experience is difficult to accumulate.

Зачем это нужно? Одна из главных проблем местного бизнеса — отсутствие крупного опыта. Чтобы получить большой международный контракт, компания должна подтвердить выполнение сопоставимых проектов. Но без крупных контрактов такой опыт накопить сложно.

At the same time, there are situations in the market where foreign companies bid on tenders with very low prices and are awarded major government projects. At first glance, this seems advantageous for the state: a lower contract value means lower budget expenditures. But there is a downside. A significant portion of the funds in this case goes to foreign contractors, and local companies are denied the opportunity to grow through large projects.

При этом на рынке бывают ситуации, когда иностранные компании заходят в тендеры с очень низкими ценами и получают крупные государственные проекты. Для государства это на первый взгляд выгодно: меньше стоимость контракта — меньше расходы бюджета. Но есть и другая сторона. Значительная часть денег в таком случае уходит иностранным подрядчикам, а местные компании не получают возможности вырасти за счет крупных проектов.

There is another problem: proving experience. A company may actually complete a large volume of work, but if the contract is divided into several parts—for example, separate delivery, production, transportation, and installation—this experience may not count as one completed project. As a result, the company may have the necessary skills, but it cannot formally confirm them for a new tender.

Есть и еще одна проблема — подтверждение опыта. Компания может фактически выполнить большой объем работ, но если контракт разделен на несколько частей — например, отдельно поставка, производство, транспортировка и монтаж, — такой опыт потом может не засчитываться как один завершенный проект. В результате у компании есть необходимые навыки, но формально подтвердить их для нового тендера она не может.

Therefore, a preference for local companies should address more than just price. It should enable businesses to secure truly large projects, gain experience, and then compete internationally.

Поэтому преференция для местных компаний должна решать не только вопрос цены. Она должна дать бизнесу возможность получить реальные крупные проекты, накопить опыт и затем конкурировать уже на международном уровне.

At the same time, it's important not to turn such a system into an automatic privilege for every local contractor. The requirements for companies, the size of the preference, and the rules for its application must be clearly defined. Otherwise, instead of supporting businesses, you could end up with less competition and more expensive projects for the state.

При этом важно не превратить такую систему в автоматическую привилегию для любого местного подрядчика. Необходимо четко определить требования к компаниям, размер преимущества и правила его применения. Иначе вместо поддержки бизнеса можно получить меньше конкуренции и более дорогие проекты для государства.

If the mechanism works correctly, public procurement can become a tool for developing the local construction sector: the money will stay within the economy, companies will gain experience, and the market will become richer in strong contractors.

Если механизм будет работать правильно, государственные закупки смогут стать инструментом развития местного строительного сектора: деньги останутся внутри экономики, компании получат опыт, а рынок — больше сильных подрядчиков.
